BBB began a file on this firm in January 2010. Based on current BBB files, this company has a rating of F. Factors that contributed to this company’s rating include the length of time this company has been in business, the number of complaints filed against this business in the past 36 months, the failure to respond to consumer complaints when brought to their attention by BBB and complaints that were not resolved. Information that could raise this company’s rating would be having sufficient background information.
BBB has processed 442 complaints against Wavee US, LLC in the past 36 months, our standard reporting period. Of these complaints, the company did not respond to 23 and 36 complaints remain unresolved. Consumer complaints are coming in from many states around the country including Oregon, California, Kentucky, Tennessee, New Jersey, Texas, Wisconsin, Florida and Hawaii.
Complainants allege they were being charged an upfront fee about which they were unaware. Consumers believe they were just visiting the site and no money was required. BBB has received many complaints where the consumer is requesting a refund of the upfront fee. Although the company has responded to some of the complaints, they will not issue a full refund stating the consumer knew this information prior to joining their site.
Other complainants allege that Wavee’s website goes down and they would not receive the product they had been bidding on. Responses from Wavee regarding this matter appear to be generic in nature and do not address the individual consumer. Wavee instructs consumers to review a section of their “Terms & Conditions” which deals with technology. Copied below is the section of Wavee’s Terms & Conditions that deals with system outages:
“At present, and with current technology, it is not possible to operate with 100% guaranteed uptime. In some cases, system outages affecting Wavee’s systems or Website may interrupt the ability to view or bid upon auctions. In this case, Wavee will halt all auctions and bidding on those auctions until the system outage is resolved. Auctions that are halted will be clearly designated as such. We reserve the right to reasonably modify any auction to account for such events as system outages. All such modifications shall be solely at our discretion. Wavee will also make commercially reasonable efforts to resume the auctions after the outage is resolved. In the event of a system-wide outage that prevents you from bidding, Wavee reserves the right to decide on whether to refund Credits used in auctions in which you were participating at the time of the auction. Wavee shall not be liable for damage that occurs due to bids submitted by auction users not being received by Wavee, or not being received promptly, or not being considered, as a consequence of technical faults.”
Wavee US, LLC advertises on their website that they have “the lowest prices.” This is an underselling claim that cannot be proved as they would have to shop every store that has the same product on a daily basis to make such a claim. Additionally, while bidding for products, Wavee advises if you don’t win, you still can purchase the product at the “lowest price online.” Again, this would require Wavee to shop every online bidding website and every site that sells the same products as they have.
